This Privacy Policy defines the principles of processing and protecting the personal data of individuals using the uniepal.com website (including those using the contact forms on the site) as well as commercial partners (product distributors) with whom written distribution agreements are concluded.

The document has been fully adapted to the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the current standards and guidelines of the President of the Personal Data Protection Office (PUODO) in force in June 2026.

2. Categories of Data Collected, Purposes, and Legal Bases

We process personal data for strictly defined purposes, minimizing their scope depending on the nature of your relationship with the Controller:

Contact Form Users (Website):

  • Scope of data: Name, phone number, e-mail address, content of the sent message (and any other data voluntarily provided therein).
  • Purpose and legal basis:
    • Inquiry handling and communication – responding to messages sent via the form. Basis: Legitimate interest of the Controller consisting in building relationships with users and handling correspondence (Article 6(1)(f) of the GDPR).
    • Direct marketing – sending commercial information and product offers. Basis: Voluntary and explicit consent of the user (Article 6(1)(a) of the GDPR).

Commercial Partners / Distributors (Written Agreements):

  • Scope of data: Company registration data (NIP, REGON, KRS), business address, first and last names as well as positions of individuals representing the company, bank account numbers, identity document numbers (if necessary to verify representation), and contact details of employees designated to manage the agreement.
  • Purpose and legal basis:
    • Contractual process execution – commercial verification, conclusion, proper execution, and settlement of the written product distributor agreement. Basis: Necessity for the performance of a contract or to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) of the GDPR).
    • Legal obligations – bookkeeping, invoicing, and fulfillment of tax and accounting obligations. Basis: Article 6(1)(c) of the GDPR.
    • Establishment and defense of claims – securing and defending against potential legal claims. Basis: Legitimate legal interest of the Controller (Article 6(1)(f) of the GDPR).

Website Visitors (Behavioral Data and Cookies):

  • Scope of data: IP address, cookie identifiers, geolocation data, history of behavior on the uniepal.com website.
  • Purpose and legal basis:
    • Technical and necessary purposes – ensuring the security and proper display of the website. Basis: Article 6(1)(f) of the GDPR.
    • Analytical, statistical, and marketing purposes – optimization of website performance and running advertising campaigns (e.g., remarketing). Basis: Informed and voluntary consent of the user expressed via the cookie banner (Article 6(1)(a) of the GDPR).

3. Data Retention Period

Your personal data is stored only for the time necessary to achieve the purposes for which it was collected:

  • Data from the contact form: For the period necessary to clarify the matter and provide a full response, but no longer than 2 years from the date of conclusion of correspondence (unless further correspondence leads to the conclusion of an agreement). Data processed on the basis of marketing consent will be processed until it is withdrawn or an objection is lodged.
  • Data from distribution agreements (collected in writing): Throughout the term of the agreement, and after its termination for the period required by tax and accounting regulations (standardly 5 years from the end of the calendar year in which the tax payment deadline related to the agreement expired) and until the statute of limitations for potential claims resulting from the Civil Code.
  • Data from cookies: For the validity period of individual cookies (from a few sessions up to a maximum of 24 months) or until they are manually cleared by the user in the web browser.

4. Recipients of Personal Data

In the course of conducting business and operating the uniepal.com website, personal data may be shared with or entrusted only to trusted third parties (on the basis of data processing agreements – Article 28 of the GDPR):

  • Technology service providers (hosting providers, e-mail operators, CRM system providers, companies maintaining the website).

5. Transfer of Data Outside the EEA

As a general rule, the Controller does not transfer personal data outside the European Economic Area (EEA). In the case of using global analytical or advertising tools (e.g., Google Analytics), the transfer of data to third countries (e.g., the USA) takes place exclusively based on current legal mechanisms ensuring compliance with the GDPR, such as adequacy decisions of the European Commission (Data Privacy Framework) or approved Standard Contractual Clauses (SCC).

6. Rights of the Data Subjects

  • Right of access: The possibility to obtain confirmation as to whether data is being processed and to obtain a copy thereof.
  • Right to rectification: The request for immediate correction of incorrect or incomplete data.
  • Right to erasure (“the right to be forgotten”): The possibility to request the deletion of data if, among other things, the legal basis for its processing has expired or consent has been withdrawn, and the data is not needed for tax purposes or defense against claims.
  • Right to restriction of processing: Halting operations on the data in situations specified in Article 18 of the GDPR.
  • Right to data portability: Transferring data in a structured format to another controller (if the processing is carried out by automated means based on an agreement or consent).
  • Right to withdraw consent: The possibility to revoke granted consent (e.g., marketing consent) at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  • Right to object: The possibility to object to the processing of data based on the legitimate interest of the Controller (including advertising profiling).
  • Right to lodge a complaint with a Supervisory Authority: If you believe that your data is being processed unlawfully, you have the right to lodge an official complaint with the Polish supervisory authority: Prezes Urzędu Ochrony Danych Osobowych (PUODO), ul. Stawki 2, 00-193 Warsaw, Poland.

7. Voluntariness of Providing Data

  • Website and Form: Providing data (name, phone, message) is fully voluntary, but constitutes a technical condition necessary to handle your inquiry and provide feedback.
  • Distributor Agreement: Providing commercial and registration data when signing a written agreement is a contractual and statutory requirement (necessary for the correct issuance of VAT invoices and financial settlements). Failure to provide this data makes it impossible to establish commercial cooperation.

8. Automated Decision-Making and Profiling

Your personal data will not be used for automated decision-making that would produce legal effects concerning you or similarly significantly affect you. Data profiling via cookies on the uniepal.com website serves exclusively statistical purposes and matching marketing content to your preferences (in case of consent to cookies).
